റോഡുവികസനത്തിന് തടസ്സമാകുന്ന അനധികൃത നിര്‍മിതികള്‍ നീക്കംചെയ്യാന്‍ കേരള സര്‍ക്കാര്‍ മടിക്കുന്നതെന്തിന്? സര്‍ക്കാര്‍ പുറമ്പോക്കുകളില്‍ ആരും എന്തും ചെയ്തിട്ട് അതിനെല്ലാം നിയമപരിരക്ഷയുള്ളതു പോലെ പ്രവര്‍ത്തിക്കുന്നത് കണ്ടുനില്ക്കുന്നത് എന്തിനാണെന്നു സാധാരണജനം അത്ഭുതപ്പെടുന്നു. നാടിന്റെ സമഗ്രവികസനമായിരിക്കണം സര്‍ക്കാരിന്റെ ലക്ഷ്യം. അതിനു വീതിയേറിയ റോഡുകളുടെ ആവശ്യകത പ്രത്യേകം എടുത്തുപറയേണ്ടതില്ല.
കേരള സംസ്ഥാനത്ത് വര്‍ധിച്ചു വരുന്ന വാഹനങ്ങളുടെ എണ്ണത്തിന് അനുസൃതമായി റോഡുകള്‍ വികസിപ്പിക്കേണ്ടത് അനിവാര്യമാണ്. എന്നാല്‍ അതിനു തടസ്സമാകുന്ന വിധത്തില്‍ വഴിവക്കിലും റോഡുപുറമ്പോക്കിലും പാതകള്‍ക്ക് കുറുകേയുമുള്ള അനധികൃത നിര്‍മിതികള്‍ നീക്കം ചെയ്യാന്‍ ഫലപ്രദവും ശക്തവും നിലനില്ക്കുന്നതുമായ സംവിധാനങ്ങള്‍ ഏര്‍പ്പെടുത്താന്‍ നടപടികള്‍ സ്വീകരിക്കേണ്ടതുണ്ട്.
സര്‍ക്കാര്‍ ഭൂമി കൈയേറി സ്തൂപങ്ങള്‍, സ്തംഭങ്ങള്‍, കമാനങ്ങള്‍, ബോര്‍ഡുകള്‍, കൊടിമരങ്ങള്‍, തൂണുകള്‍, കാണിക്കവഞ്ചികള്‍, നേര്‍ച്ചപ്പെട്ടികള്‍, ശിലകള്‍, ആല്‍ത്തറകള്‍, കുരിശടികള്‍, സ്മാരകങ്ങള്‍, ശില്പങ്ങള്‍, പ്രതിമകള്‍, കബറുകള്‍ തുടങ്ങിയവ അനധികൃതമായി നിര്‍മ്മിക്കുകയും/സ്ഥാപിക്കുകയും അനുമതിയില്ലാതെ അവ നിലനിര്‍ത്തുകയും ചെയ്യുന്നത് സംസ്ഥാനത്ത് വ്യാപകമാണ്. വിവിധ സംഘടനകളും മതവിഭാഗങ്ങളുമാണ് മുഖ്യമായും ഇവയ്ക്കു പിന്നിലെന്നുള്ളതുകൊണ്ട് അവ ഒരിക്കലും നീക്കം ചെയ്യപ്പെടുന്നില്ല.
ചെറുതായി തുടങ്ങി കാല്‍നടയാത്രയും വാഹന ഗതാഗതവും തടസ്സപ്പെടുത്തുന്ന വിധത്തില്‍ അവ പരിസരത്തേക്ക് വ്യാപിപ്പിക്കുകയാണ് സാധാരണ ചെയ്യുന്നത്. ഇത്തരത്തില്‍ ചെറുതും വലുതുമായ അനേകം നിര്‍മ്മിതികള്‍ സംസ്ഥാനത്തുടനീളം കാണാം. സ്ഥാപിച്ചു എന്നു കരുതി ആര്‍ക്കും അത് അവകാശമാകുന്നില്ല. കുറച്ചു വര്‍ഷങ്ങള്‍ കഴിയുമ്പോള്‍ അത് അവകാശമായി അനുവദിക്കുന്ന സര്‍ക്കാര്‍ പ്രീണന നയമാണ് അവസാനിപ്പിക്കേണ്ടത്. സംഘടിതരല്ലാത്ത നാട്ടുകാര്‍ അനുഭവിച്ചോട്ടെ എന്ന നിലപാടില്‍ സംഘടിത ശക്തികളെന്നു കരുതുന്നവരെ പിണക്കാതെ അനധികൃത നിര്‍മാണ പ്രവര്‍ത്തനങ്ങള്‍ ദൃഡീകരിച്ചു നല്കാന്‍ പൊതുജനങ്ങളാല്‍ തെരഞ്ഞെടുക്കപ്പെട്ട ജനകീയ സര്‍ക്കാരിന് എങ്ങനെ കഴിയുന്നു?.
റോഡുവക്കിലെ ചെറിയ ആല്‍ത്തറകള്‍ വികസിപ്പിച്ച് ചുറ്റും മേല്‍ക്കൂരയും മറ്റും സ്ഥാപിച്ച് ക്ഷേത്രങ്ങളാക്കുന്നതും കൊടിമരങ്ങള്‍ക്ക് ചുറ്റും ഭൂമി വളച്ചുകെട്ടുന്നതും സംസ്ഥാനത്ത് എവിടേയും ദൃശ്യമായ ഉദാഹരണങ്ങളാണ്. പലയിടങ്ങളിലും വീതികൂട്ടല്‍ അടക്കമുള്ള റോഡുവികസനം ഇതു മൂലം തടസ്സപ്പെടുകയും അപകടങ്ങള്‍ക്ക് കാരണമാകുകയും ചെയ്യുന്നു. സംഘടിത ശക്തിയും മത, സാമുദായിക പരിഗണനകളും കണക്കിലെടുത്തും സംഘര്‍ഷമുണ്ടാകുമെന്നു ഭയപ്പെട്ടും ഭൂരിപക്ഷം പൊതുജനങ്ങള്‍ക്ക് ശല്യവും തടസ്സവുമാകുന്നതും സുരക്ഷാഭീക്ഷണിയുള്ളതുമായ അനധികൃത നിര്‍മിതികള്‍ നീക്കം ചെയ്യാത്തത് നിയമവിരുദ്ധവും അനീതിയുമാണ്. വര്‍ഷങ്ങള്‍ കഴിയുന്നതോടെ അവ ഒരിക്കലും മാറ്റാനാകാത്ത സ്ഥിരം ഏര്‍പ്പാടായി മാറുന്നു. അതുപോലെ തന്നെ വഴിവക്കിലെ മരങ്ങള്‍ കൈയേറി ആണിയടിച്ചും മറ്റും ബോര്‍ഡുകള്‍ സ്ഥാപിക്കുന്നതും തടയണം.
അതിനാല്‍ നാടിന്റെ വികസനത്തെക്കരുതി അനധികൃതവും തടസ്സമുണ്ടാക്കുന്നതുമായ നിര്‍മിതികള്‍ നീക്കം ചെയ്യുന്നതിനുള്ള തുടര്‍നടപടികള്‍ക്ക് നേതൃത്വം നല്കുന്നതിനായി ഒരു മോഡറേറ്ററെനിയമിക്കാനുള്ള നടപടികള്‍ സ്വീകരിക്കണമെന്ന് സര്‍ക്കാരിനോട് അഭ്യര്‍ഥിക്കുന്നു. പരാതികള്‍ സ്വീകരിക്കാനും തടസ്സമായ നിര്‍മിതികള്‍ നീക്കം ചെയ്യാനായി ഉത്തരവിട്ട് നടപ്പിലാക്കാനും അധികാരമുള്ള മോഡറേറ്ററെയായിരിക്കണം നിയമിക്കേണ്ടത്.
അനധികൃത നിര്‍മിതികള്‍ സ്വയം നീക്കം ചെയ്യാന്‍ ബന്ധപ്പെട്ടവര്‍ക്ക് ആദ്യം സമയം അനുവദിക്കണം. പിന്നീട് നില നില്ക്കുന്നവയ്‌ക്കെതിരേ പരാതികള്‍ സമര്‍പ്പിക്കാന്‍ പൊതു ജനങ്ങള്‍ക്ക് അവസരം നല്കണം. അങ്ങനെയുള്ള പരാതികള്‍ പരിഗണിച്ച് അനുരഞ്ജനത്തിന്റെ മാര്‍ഗത്തിലൂടെ തീര്‍പ്പുകല്പ്പിക്കാനും നഷ്ടപരിഹാരം ഈടാക്കാനായി ഉത്തരവിടാനുമാണ് മോഡറേറ്റര്‍ക്ക് അധികാരം നല്‌കേണ്ടത്. തുടര്‍ന്ന് ക്രിമിനല്‍ നടപടി ചട്ടം തുടങ്ങി നിലവിലുള്ള നിയമങ്ങള്‍ പ്രകാരം തുടര്‍നടപടികള്‍ സ്വീകരിക്കാവുന്നതാണ്. ഇക്കാര്യത്തില്‍ കര്‍ശനമായ നടപടികള്‍ തുടര്‍ച്ചയായി ഉണ്ടായാല്‍ പൊതുജനങ്ങള്‍ക്കു തന്നെയാണ് ഏറെ പ്രയോജനപ്പെടുക. കൈയൂക്കു ഭയന്നു സങ്കുചിത-സംഘടിത ശക്തികളെ സര്‍ക്കാര്‍ പ്രോത്സാഹിപ്പിക്കേണ്ടതില്ല.
രാഷ്ട്രീയസംഘടനകളുടേയും മത, സാമുദായിക വിഭാഗങ്ങളുടേയും ആത്മാര്‍ഥമായ സഹകരണം ഇതിന് ആവശ്യമാണ്. അതിന് കേരള സര്‍ക്കാര്‍ നേതൃത്വം നല്കണ്ടേതുണ്ട്. തടസ്സമായിട്ടുള്ളവ നീക്കം ചെയ്യാന്‍ പരസ്പരണധാരണയും വിട്ടുവീഴ്ചയും അത്യാവശ്യമാണ്. കൊച്ചി ഷിപ്പ്‌യാര്‍ഡിന്റെ വികസനത്തിനായി അവിടെയുണ്ടായിരുന്ന ഒരു പള്ളി മറ്റൊരിടത്തേക്ക് മാറ്റിസ്ഥാപിച്ചത് മാതൃകയായി എടുത്തുകാട്ടാവുന്നതാണ്. തിരുവനന്തപുരം തുമ്പയില്‍ റോക്കറ്റ് ഗവേഷണത്തിനു തുടക്കമിട്ടതും ഒരു ക്രിസ്ത്യന്‍ പള്ളിയിലാണ്. സങ്കുചിത മനസ്ഥിതി ഒഴിവാക്കാനുള്ള ബോധവത്കരണം നടത്തിയാല്‍ നാടിന്റെ പുരോഗതിക്ക് നാട്ടുകാര്‍ ഇക്കാര്യത്തില്‍ വേണ്ടുന്ന സഹായസഹകരണങ്ങള്‍ സന്തോഷത്തോടെ നല്കുമെന്നാണ് പ്രതീക്ഷ. അതിനായി സര്‍ക്കാര്‍ മുന്നിട്ടിറങ്ങുകയാണ് വേണ്ടത്. വേണ്ടത് ഇച്ഛാശക്തിയും.
ഈ വിഷയം സംബന്ധിച്ച് 2005 മുതല്‍ ഈ ലേഖകന്‍ ലേഖനങ്ങളെഴുതുന്നു. കേരള മുഖ്യമന്ത്രിയ്ക്കും മറ്റും 2007 ഡിസംബര്‍ 25-ന് അയച്ച കത്തിന് മറുപടിയേ കിട്ടിയിട്ടില്ല. തുടര്‍ന്ന് മുഖ്യമന്ത്രി, ആഭ്യന്തര മന്ത്രി, വൈദ്യുതി മന്ത്രി, പൊതുമരാമത്ത് മന്ത്രി, റവന്യൂ മന്ത്രി, ധനകാര്യ മന്ത്രി, നിയമ മന്ത്രി, ഗതാഗത മന്ത്രി, ചീഫ് സെക്രട്ടറി, പബഌക് റിലേഷന്‍സ് വകുപ്പ് ഡയറക്ടര്‍എന്നിവര്‍ക്ക് 2010 ജനുവരി മൂന്നിനു അയച്ച ഓര്‍മ്മപ്പെടുത്തല്‍ കത്തിനും മറുപടിയൊന്നും ഇതുവരെ ലഭിച്ചിട്ടില്ല.
ഇതിനിടെ ഒരു കേസിലെ രാജ്യത്താകമാനം ബാധകമായ സുപ്രീം കോടതി ഉത്തരവു പ്രകാരം റോഡുവക്കില്‍ തടസ്സമായി നില്ക്കുന്ന ക്ഷേത്രങ്ങള്‍ ഉള്‍പ്പടെയുള്ള നിര്‍മിതികള്‍ പല സംസ്ഥാനങ്ങളിലും പൊളിച്ചുനീക്കപ്പെട്ടുകഴിഞ്ഞു. കേരളത്തിലാകട്ടെ ഏറ്റവും പുതിയ, തൊട്ടടുത്ത ഒന്നോ രണ്ടോ വര്‍ഷങ്ങളില്‍ പണിതവ മാത്രമേ പൊളിച്ചുനീക്കലിന്റെ പട്ടികാ പരിധിയില്‍ വരുകയുള്ളുവെന്നാണ് പറഞ്ഞു കേള്‍ക്കുന്നത്. അങ്ങനെയായാല്‍ ആര്‍ക്കും എവിടേയും കൈയേറി എന്തും ചെയ്തു നിലനില്ക്കാമെന്ന സന്ദേശമാണ് സര്‍ക്കാര്‍ നല്കുക. നാടിന്റെ ധമനികളായ റോഡുകളില്‍ തടസ്സമായ എല്ലാം നീക്കം ചെയ്യുകയാണ് വേണ്ടത്.

സര്‍ക്കാര്‍ ഭൂമിയിലും പൊതുസ്ഥലത്തുമുള്ള ആരാധനാലയങ്ങളുടെ പട്ടിക തയാറാക്കണമെന്നു ഹര്‍ജി ആദ്യം പരിഗണിച്ച സമയത്തു കോടതി നിര്‍ദേശിച്ചിരുന്നു.

Taking a serious note of the mushrooming illegal roadside religious places, the Rajasthan high court has directed the state government to
come out with a plan within a month for the removal of 58,000 such structures in the state.
The direction came after the court suo moto took up the issue following complaints of
inconvenience to the public with such illegal
structures coming up on roadsides and on public land.
A division bench of the high court comprising acting chief justice Arun Mishra and justice M Rafiq directed the Rajasthan government to prepare a concrete plan within a month outlining how these structures can be removed.
The state government in its response had submitted that there were 58,000 illegal religious structures in the state.
"We appreciate religious feelings associated with places of worship but still God and Goddesses too will feel bad sitting on a roadside or a nallaha. Temples are not like roadside vendorshops that can be installed anywhere. We cannot allow encroachments in the name of temples," Justice Mishra observed.
Justice Mishra also issued an advisory to the advocate general of the state saying, the government must itself take a decision to dismantle these encroachments or the court will be forced to step in and take action.
Advocate General G S Bapna submitted to the bench that the state government has framed a policy to demolish all those illegal religious
roadside structures causing traffic hazards.
He said those structures which would be demolished will, however, be relocated in a nearby vicinity.
Bapna said the government has decided to regularise those temples and mosques that are not causing any traffic hazard.Under the policy, places of worship would be clearly earmarked in all the upcoming colonies, he said.
A single judge of the court in January this year taken suo moto cognizance of the illegally constructed temples and mosques on roadsides and public land.
The court had then asked the state authorities to explain that despite Supreme Court's verdict in this regard why public land is being allowed to be encroached by persons who try to grab the land in the name of building temples and mosques.

HYDERABAD: GHMC in conjunction with the traffic police will take up an encroachment removal drive, especially concentrating on road margins and footpaths as per the directions of the High Court as well as the Lok Ayukta.
Commissioner Sameer Sharma on Friday directed all the zonal and deputy commissioners to personally monitor the drive from July 24 to July 29 as such illegal encroachments were not only causing inconvenience to pedestrians but also resulting in traffic jams in that particular area, he pointed out.
Additional Commissioner (Planning & Projects) K. Dhananjaya Reddy said that 15 major roads were identified for the drive. Business establishments lacking adequate parking are liable to be closed down. Multiplexes, cinemas, function halls, hotels, schools; hospitals and so on should prepare a Detailed Transport Circulation Plan to GHMC and traffic police.
A special drive will also be taken up to remove parking violations in all the buildings where sanctions have been given for provision of parking spaces.
Special notices are to be issued to occupiers/owners of the buildings who had converted parking spaces into other usages.
If necessary, demolitions will be taken up in line with the HC directions wherever parking spaces are either insufficient or there is no parking space.
Special notices will be issued to either provide parking space or an alternate space for parking within a reasonable period of time and failing to do so will result in sealing of the premises under HMC Act and Public Health Act.
The roads identified are: Khairatabad Junction to Erragadda, Liberty to Narayanguda, YMCA junction to Taj Hotel via King Koti, Koti centre, NMDC Junction (Masab Tank) to Rethibowli, “Y” junction Kukatpally to JNTU Kukatpally, JNTU junction to Raintree Park junction and Miyapur junction to BHEL junction.
IICT junction Tarnaka to Mettuguda junction, Secunderabad station area, Chaderghat bridge to Dilsukhnagar, Chandrayangutta to Pisalbanda, I.S.Sadan to Santosh Nagar.

Illegal religious structures have encroached upon Bangalore’s footpaths, streets and public spaces. The menace seems destined to stay, despite a Supreme Court Order..
All in God’s name!
God-fearing you might be, but the sight of a makeshift temple, darga or a church encroaching upon the footpath is bound to upset you. Now, here’s one news that’s sure to upset you more: Hardly a few of the 630 plus such illegal religious structures in Bangalore are likely to be razed, because the civic authorities fear it might hurt religious sentiments and trigger trouble!
This, despite a clear Supreme Court direction (issued on September 29, 2009) that the State Governments ought to stop the mushrooming of such encroachments. The apex court had asked the governments to frame a comprehensive policy in this regard, identify the unauthorised religious structures in public places, and make plans to remove or relocate these.
Bangalore’s exponential vehicular growth coupled with an acute paucity of wide roads has triggered traffic chaos of monumental proportions. Road-widening to address this issue has virtually spelled doom for the footpaths. The last thing the hapless pedestrians would want is a soft option on these encroachments, masquerading as godly structures!
Clearly, the Government wanted to convince the Supreme Court that it was serious about stopping the illegal structures’ menace. Affidavits were filed listing the number of such structures. According to Karnataka’s affidavit, there were 2,814 illegal structures across the State. Official records show that the Bangalore Urban district alone had 324 such temples, mosques and churches till December 7 last year, besides the 630 within the City. The numbers could be much higher if the current year’s statistics are added.
But beyond the numbers, the Government or the civic agencies don’t appear to have a plan to remove the existing structures. The Bruhat Bangalore Mahanagara Palike (BBMP), at the behest of the SC and State Government directives, has begun mapping these illegal religious structures. Yet, the fact-finding is very unlikely to be followed by demolitions.

ReplyDeleteHere’s why, as explained by the Palike Commissioner Siddaiah himself: It is quite impossible to remove these encroachments without flaring public emotions in a god-fearing country and city, says he. “While we can ensure that further illegal structures do not crop up in the City, the removal of the already constructed structures is a controversial topic,” he contends.
Yet, there is room for optimism. For instance, Deputy Commissioner, Bangalore Urban, M K Aiyappa feels the Supreme Court directive could make the removal of these structures easier. “With co-operation from the citizens, the matter could be resolved,” says he.
The Urban DC, whose jurisidiction covers Anekal and Bangalore South, informs that the illegal temples, mosques and churches in these locations will be regularised and handed over to the Muzrai department. “Only those which have been constructed on the streets will be demolished and shifted out.”
Aiyappa cites the example of a temple in Anekal. After a detailed discussion with the local MLA, this temple -- which is right in the middle of a road -- is now being demolished and an alternative structure built inside a nearby temple complex.
But the question remains, whether this strategy could be replicated in the City
centre, where illegal religious structures of every hue have cropped up. On footpaths, streets and even civic amenity sites. While some are obscure structures which few
visit, others have a large following, as is apparent from the big crowds that throng these spots, leading to intense traffic chaos.
Strong-arm tactics to rid the City of these illegal structures could be an invitation to disaster, warn sceptics. It might be easier to handle the issue on the outskirts of the City, but the real test lies in the City’s core, they argue.
The pressure from the Supreme Court and the public to act against the encroachments might be intense. But it is anybody’s guess how the Palike will handle the issue.
Indications are that the City would just have to live with the existing structures. It is learnt that at a recent BBMP meeting, the officials wanted almost all of the roadside and encroached religious structures to be legalised. The intention is clear: Circumvent the Supreme Court order to ensure there are no illegal structures.
The argument goes this way: If a scheme like Akrama-Sakrama could be devised to regularise unauthorised houses, why not something for the abodes of gods. Yet, the fact remains that regularisations would only be at the cost of the roads, footpaths, parks, playgrounds and other public spaces, all so crucial for the Bangalorean.

‘Formulate guidelines on evicting unauthorised religious structures'

Supreme Court gives States three weeks to file affidavit in this regard
The Supreme Court on Tuesday asked those States and Union Territories that had not yet formulated a comprehensive policy on the removal, relocation and regularisation of unauthorised religious constructions to do so within three weeks and file an affidavit.
A Bench of Justices Dalveer Bhandari and Deepak Verma noted that pursuant to its December 7, 2009 order asking the States to prevent the unauthorised construction of temples, churches, mosques or gurdwaras in streets, parks or other public places, many States had not filed affidavits formulating the required policy guidelines. Therefore, the Bench granted three weeks and directed the Chief Secretaries to file an affidavit in this regard.
Among the States which did identify the unauthorised religious structures include Madhya Pradesh, Karnataka, Gujarat, Rajasthan, Tamil Nadu, Orissa, Tripura, Himachal Pradesh, Goa, Delhi.
Tamil Nadu had the most number of unauthorised religious structures in public places, at 77,453, followed by Rajasthan with 58,253 and Madhya Pradesh with 51,624. Other States were Maharashtra with 17,385, Gujarat with 15,000, Karnataka with 2,814 and Delhi with 52.
In its response, Tamil Nadu said: “Of the 77,453 unauthorised structures, encroachments by temples [are] 73,599; churches, 2,002; mosques, 856; gurdwaras 1 and others 995.” It said “the State had evolved a strategy for removing unauthorised structures at public places without hurting people's sentiments. This includes the process of identification to relocate the said structure.”
PUBLIC INTEREST
A well-focussed policy was framed, particularly for the eviction of encroachments on public lands. It is aimed at identifying and removing/relocating/regularising the encroachments — by way of religious structures — in the interest of “free movement of the public; protection of public interest; maintenance of public order and use of land for public purposes.”
A high-level committee was constituted under the chairmanship of Revenue Minister to deal with eviction as well as to monitor the progress of eviction proceedings. The court's orders were communicated to all District Collectors.
HC notice to government to remove illegal constructions
ReplyDeleteNew Delhi, Oct 31: The city government was today asked by the Delhi High Court to respond to a PIL seeking removal of illegal encroachments and constructions on the city roads for free flow of traffic and common use.
A bench of Chief Justice D Murugesan and Justice Rajiv Sahai Endlaw issued notices to the Delhi government and also to the Delhi Development Authority (DDA), Municipal Corporation of Delhi (MCD), city police and sought their responses by February 6, 2013.
The court was hearing a PIL filed by Anil Dutt Sharma, a resident of New Seemapuri, seeking directions to government and other authorities to remove entire "illegal" constructions of city roads. The petition said "direct Delhi government, DDA, MCD and police to remove entire illegal encroachments, illegal constructions on the pavements, roadsides, roadside-drains, parking places, common areas, green lands in the entire areas of Delhi and also to clear each and every road, lane, park, parking area and common place in Delhi for free traffic and common use as per the existing mater plan."
Appearing for the petitioner, advocate Asit Kumar Roy said the petitioner has filed various RTI applications seeking information of status of encroachment and unauthorised constructions, actions and remedies for free footpath, parks, pavements, common parking areas, green belts and areas of mandatory free-lands from encroachments. The petition said "the innocent general public of all classes in Delhi are exploited and were subjected to mental agony and physical harassment."
